These Terms and Conditions of Sale (hereinafter the ” Terms and Conditions“) apply to the online shop www.inelli.ee (hereinafter the “Online Shop”).

The owner of the online shop is Inelli Holding OÜ, with the registration code EE101173933, located at Mäealuse 10, warehouse 10, Tallinn 12618 Estonia (hereinafter referred to as the Seller).

The person who makes a purchase from the Online Shop (hereinafter referred to as the Buyer) accepts these Terms and Conditions and undertakes to comply with them.

In addition to these Terms and Conditions, the legal relations arising from the purchase of products from the Online Shop are regulated by the Law of Obligations Act (hereinafter LOA), the Consumer Protection Act (hereinafter CPA) and other legislation in force in the Republic of Estonia.

The Seller has the right to make changes to the Terms and Conditions, which will be published on the Webshop.

Sales contract, drawing up a sales order

The sales contract is deemed to be concluded when the Buyer places a sales order in the Online Shop.
Once the sales order has been placed, the Buyer undertakes to pay the purchase amount by bank transfer or by bank transfer on the basis of a prepayment invoice.
The Seller will dispatch the goods indicated in the sales order after the full amount of the purchase has been credited to the Seller’s bank account.

A sales order for which the Buyer has not paid within two days of the date of the sales order will be cancelled.

If the Buyer wishes to cancel the sales order, the Buyer undertakes to send a declaration of intent to this effect to the Seller by e-mail to info@inelli.ee or by contacting the Seller via the contact form of the Online Shop.

Products

The products sold in the Online Shop are available on the Online Shop.
Product images on the Online Shop are illustrative and may differ from the actual product.
The descriptions of the products on the Online Shop are not necessarily exhaustive.
Where the Seller has provided links to third party websites, the Seller does not warrant that the information displayed when clicking on these links is correct, complete or accurate.
The content, accuracy, completeness and correctness of the information provided by third parties are the responsibility of the third parties.
The Seller is under no obligation to verify external information transmitted or stored or to identify illegal activities.

Price and payment

The price of each product offered on the Online Shop is indicated with the corresponding product.
The prices of all products include VAT.
All prices are in Euro.
The prices shown in the Online Shop are valid only for purchases made in the Online Shop.

The prices of products offered in the online shop are subject to change.
It is the responsibility of the buyer to ascertain the purchase price of the products at the time of placing the sales order.

The price of the Products is subject to a delivery charge, which depends on the location of the Buyer and the delivery method.
Free delivery within Estonia for sales orders with a purchase price of at least EUR 75.
Orders of a lower value will be subject to an additional delivery charge according to the delivery method chosen by the Buyer.

When you place a sales order, you will receive an order confirmation, or prepayment invoice, to the e-mail address you entered in the sales order form.
If the sales order is paid by bank transfer, the prepayment invoice does not need to be paid again.

If the Buyer has opted for bank transfer as the payment method, he/she is obliged to pay the invoice for the advance payment.
Sales orders for which the invoice for payment on account has not been paid by the Buyer within two days of the date of submission of the sales order shall be cancelled.

If the product is not in stock

In case the product indicated in the sales order is not available in the Seller’s warehouse, the Seller shall inform the Buyer by e-mail or by telephone no later than the next business day after the purchase price indicated in the sales order is credited to the Seller’s bank account.
In such a case, the Buyer shall be entitled to:

  • agree to an additional waiting period for the arrival of the products;
  • cancel the sales order, in which case the Seller will refund the Buyer the amount paid for the sales order.
Delivery

The Buyer can choose between the following options to receive the Products:

  • a parcel machine;
  • courier service;
Parcel machine

We can send orders with a total weight of 30 kg or less to parcel machines.
The parcel must be picked up at the parcel terminal within the time limit set by the postal service provider.

Courier service

The product purchased from Monday to Thursday and delivered by courier will be delivered by courier to the address indicated by the Buyer on the day following the day of purchase between 09.00 and 20.00.
The product purchased from Friday to Sunday will be delivered by courier to the address indicated by the Customer no later than the following working day between 09.00 and 20.00.
The exact time of delivery of the product shall be agreed with the Customer in advance by the courier by telephone.

The Buyer must ensure receipt of the product at the agreed time and address.
In the event that the Buyer is not available at the time of arrival of the product, the courier will make one additional attempt to deliver the product.
If both attempts to deliver the Product to the Customer are unsuccessful, the Seller shall consider that the Buyer has cancelled the order and shall refund the amount of the purchase to the Buyer, free of delivery charges, without undue delay, but not later than 14 calendar days, to the same account from which the purchase was paid.

If you choose a courier to deliver your goods, a delivery charge will be added to the price of the goods.
Prices include VAT.

If the Buyer chooses to collect the products by parcel or courier, the Buyer’s mobile phone number must always be provided (landline numbers do not allow this service).

Buyers are welcome to come and pick up the products at Mäealuse 10, Ladu 10, Tallinn.

Right of return

After receipt of the product, the Buyer has the right to withdraw from the e-shop contract within 14 days.
The right of withdrawal does not apply if the Buyer is a legal person.

The product to be returned must be undamaged, unused and in its original packaging.

In order to exercise the 14-day right of return, the product ordered may not be used in any other way than is necessary to ascertain the nature, characteristics and functioning of the product, in the same way as is permitted for testing the product in a physical shop.
Familiarisation means the equivalent use as if you were to familiarise yourself with it in a retail shop before making a purchase.

If the product has been used for purposes other than those necessary to ascertain the nature, characteristics and functioning of the goods, or if it shows signs of use or wear, the Online Shop has the right to reduce the refundable fee in accordance with the reduction in the value of the goods.

In order to return the goods, you must submit a withdrawal form.

The cost of returning the product is borne by the Buyer, unless the reason for returning the product is that the product to be returned does not correspond to what was ordered (e.g. wrong or defective product).

The purchaser must return the goods within 14 days of the date of the application or provide proof that he/she has handed over the goods to the carrier within the aforementioned period.

The online shop will refund the order fee to the Buyer immediately upon receipt of the returned product, but not later than 14 days.

Making a complaint

The Seller shall be liable for any non-conformity or defect in the Product sold to the Buyer which existed at the time of delivery and which becomes apparent within a period of up to two years from the delivery of the Product to the Buyer.
During the first six months after the delivery of the goods to the Buyer, the defect shall be presumed to have existed at the time of delivery, unless such presumption is incompatible with the nature of the product or of the defect.

In the event of a defect, the Buyer has the right to contact the Seller within two months at the latest by sending an e-mail to info@inelli.ee.

The Seller shall not be liable for defects arising after delivery of the product to the Buyer.

The Seller shall not be liable for any defects in the product caused by the Buyer or the user of the product as a result of improper storage or improper use of the product.

If a product purchased from the Online Store has defects for which the Seller is responsible, the Seller will repair or replace the defective product.
If the product cannot be repaired or replaced, the Seller will refund to the Buyer all the fees paid under the sales contract.

The Seller’s liability is limited to direct material damage caused to the Buyer.
Loss of income and non-material damage suffered by the Buyer shall not be compensable.
The limitation of liability does not apply to the extent that the law does not allow the limitation of the seller’s liability, including in the case of intentional and grossly negligent breach by the seller and in the case of death of or damage to the health of the buyer.

The seller shall respond to the complaint made by the consumer Buyer in writing or in a format that can be reproduced in writing within 15 days.

If the Buyer and the Seller are unable to resolve the dispute by agreement, the Buyer may refer the dispute to the Consumer Disputes Committee.

The Consumer Disputes Committee is competent to settle disputes arising out of a contract between the Buyer and the Seller.
The examination of the buyer’s complaint by the Commission is free of charge.

The buyer can turn to the European Union’s consumer dispute resolution platform.

Data protection

By entering data in the Online Shop, the Buyer grants the right to collect and process his/her personal data and to forward personal data to the Seller’s logistics partner for the delivery of the goods.
All personal data of the Buyer disclosed during the visit to the Online Shop and during the purchases will be treated confidentially and only for the purpose of fulfilling the order.

The use of electronic personal data for marketing purposes will only take place if the Buyer has given his/her explicit consent.
Upon request, the Buyer has the right to request the deletion of his/her data from the Seller’s Online Shop database.

Encrypted data communication with banks when settling purchases ensures the security of the Buyer’s personal banking details, which are not accessible by the Seller.
